But then I'd have to re-encode the mp3 and be subject to licensing terms. Redistributing existing mp3s that were encoded legally is safer.

That is pretty cute.
Its a shame that we can't email mp3 or some other type of audio to our LJ accounts and run an audio blog that way. The fear of dealing with people who would upload songs pretty much kills the possibility, but still.... if only it could be done.

The m3u seems to actually crash my Xine-based build of Totem. It seems to be fine with a local MP3.
I don't have XMMS installed, because I went on a little "package cleaning" rampage the other day and decided to get rid of all my gtk1 apps because I didn't use any of them and it let me delete all the gtk1 stuff.

No need to recompress; Flash supports mp3. You could write something to feed a bit of flash URLs to play.
I've started hacking something similar, but in Java because 1) I don't have to hunt down someone with a copy of Flash and 2) I can support Ogg and Wav posts.
